How Long Does an Expungement Take?

How Long Does an Expungement Take???
Most cases in California take between two and six months to have cleared.  However, some counties and courthouses are busier than others.  The general rule is that the busier the courthouse then the longer it is going to take for the court to process the expungement.  The typical case in California takes about 2 to 5 months. The courts operate on a first-come, first served basis, so the sooner you start, the sooner your record is cleared.

Will I Need to Physically Appear in Court?
It depends.  In many cases your appearance is not required.  However, certain courthouses and jurisdictions will routinely have their prosecutors object to all expungements and the clerk’s office will set it for hearing.  Other courthouse will routinely “not object” to any expungement request.
