Busiest days in criminal court

The busiest day in criminal court is Tuesday or the second weekday after a 3 day weekend.  Expecting the judge or prosecutor at that time to patiently listen to your bargaining position is misguided.  Timing, as in life, is everything in the criminal justice system.  Asking for a continuance during the holiday season is almost a no-brainer.  After all, who wants to work on Christmas Eve…even if you don’t celebrate Christmas!  Judges, attorneys and court staff are always in better moods on Fridays.  However, don’t expect the court to listen to you patiently at 4:25 on a Friday afternoon….they want to go home too.
